Warranty
SPORTS WONDERLAND guarantee statement: 24 months, within the European Union.
1. Guarantor and contact
The Guarantor is SPORTS WONDERLAND spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, al. Jana Pawła II 43A/37B, 01-001 Warszawa, Poland, KRS 0001047402, NIP 5273066199. Address for guarantee handling and shipments: ul. Wiejska 28, 56-400 Oleśnica, Poland. E-mail: office@sportswonderland.pl, telephone: +48 516 733 223.
2. Products and scope
The guarantee applies to the SPORTS WONDERLAND product accompanied by this statement. It covers material, manufacturing and assembly defects becoming apparent during proper use in accordance with the intended purpose and the instructions. In a bag-with-light set, the cover applies to the bag, the light supplied with it and the other components of the set in respect of such defects.
3. Period and territory
The guarantee is valid for 24 months from the date the product is handed over to the buyer, within the territory of the European Union.
4. Making a claim
A claim may be submitted to the Guarantor by e-mail, telephone or in writing to the addresses given above. You may also approach the seller of the product to have the claim forwarded to the Guarantor.
Please describe the problem, provide contact details and information allowing the product and the date it was handed over to be identified, e.g. the order number or other proof of purchase. Photographs or video may make the assessment easier but are not mandatory. We do not require the original receipt, the original packaging or a completed or stamped guarantee card. Their absence does not deprive you of your rights if the product and the entitlement to the guarantee can be shown in another way.
5. Performance and costs
In the case of a defect covered by the guarantee, the Guarantor repairs the product free of charge or replaces it with a defect-free product. If repair or replacement is not possible, the Guarantor may propose another appropriate solution, including a refund of the product price.
If the assessment or performance of the guarantee requires the product to be delivered, delivery and return are at the Guarantor's expense on the terms of Article 580 of the Polish Civil Code. To organise transport efficiently, please contact us in advance. Contact is not a condition for the rights to arise.
As this guarantee does not specify a different time limit for the performance of the Guarantor's obligations, Article 580 § 2 of the Polish Civil Code applies: the Guarantor performs its obligations without undue delay and no later than 14 days from delivery of the item by the beneficiary. The time limit for performing guarantee obligations is separate from the statutory time limit for the seller's response to a consumer complaint.
6. Exclusions
The guarantee does not cover damage resulting from use contrary to the intended purpose or the instructions, external mechanical damage after hand-over, improper storage, maintenance or transport by the user, or repairs or modifications by unauthorised persons, where these contributed to the defect reported. It does not cover normal wear resulting from proper use.
The exclusions apply only to damage resulting from the cause listed. Wear alone, a mechanical mark or the use of an accessory of another brand does not justify automatic refusal. Premature wear caused by a material, manufacturing or assembly defect is assessed under the guarantee. These rules do not limit the seller's liability for lack of conformity of the goods with the contract.
7. Running of the period after repair or replacement
In accordance with Article 581 of the Polish Civil Code, after replacement of the product with a defect-free one or after significant repairs, the guarantee period runs anew from delivery of the defect-free product or return of the repaired product. Where a part is replaced, this rule applies accordingly to the replaced part. In other cases the guarantee period is extended by the time during which the beneficiary was unable to use the product because of a defect covered by the guarantee.
8. Independence of statutory rights
In the event of a lack of conformity of the goods sold with the contract, the buyer is entitled by law to legal remedies from and at the expense of the seller. The guarantee does not affect those legal remedies. Use of the guarantee is voluntary and does not exclude or limit the possibility of submitting a complaint to the seller for lack of conformity of the goods with the contract. Choosing one basis for a complaint does not deprive the buyer of the rights arising from the other on the statutory terms.
